The Contested Default and Mediation Manager’s primary responsibility will be the monitoring and management of the Mediation and Case Specialists. Will review industry standards and coordinate with senior management in creating and maintaining processes and procedures for non-jury trial litigation and contested foreclosure matters. Will act as a liaison for the attorney, lines of business and/or investor in the resolution of the aforementioned matters. In addition to the management of contested matters, the Manager will have oversight of all meditation activity on default files. It will be the Manager’s responsibility to ensure a timely resolution to all mediation matters while complying with investor/insurer guidelines.
Essential Job Functions:
• Ability to effectively communicate information relating to litigation and contested foreclosure matters to appropriate departments
• Problem solve and seek out the best solution in attempts to settle contested and mediation matters
• Manage litigation and contested foreclosure matters with legal department and local counsel
• Resolve routine issues including, but not limited to: settlement discussions, eminent domain, Qualified Written Response, cease and desist orders, title issues and matters involving the deceased borrower(s)
• Daily monitoring of contested legal matters, new pleadings, issues and holds, and coordination with outside counsel
• Maintain knowledge of litigation and mediation processes/industry challenges and solutions
• Establish and maintain strong, effective working relationships with attorney, and servicing/investor partners
• Maintain a high level of customer service through proactive communications with investors, attorneys and employees
• Stay abreast of all investor/insurer Loss Mitigation guidelines
• Act as a point of contact/liaison with the attorney, ensuring that policies and procedures are followed, including compliance with federal laws and regulations
• Approves fee authorization request by attorney not to exceed the limits established for approval by the Company
• Demonstrates professional behavior and teamwork, is punctual, dependable and adheres to Company policies and procedures
Other Related Duties:
Performs other related duties as assigned
Travel to on-site mediations, hearings, trials as needed- approximately 25% travel
Supervisory Responsibilities:
Manages staff and carries out supervisory responsibilities in accordance with the organization's policies and applicable laws. Responsibilities include interviewing, hiring, and training employees; planning, assigning, and directing work; appraising performance; rewarding and disciplining employees; addressing complaints and resolving problems.
