REPORTS TO: Director – Trade & Regulatory Compliance
PURPOSE:
The Manager of Trade and Regulatory Compliance is responsible for leading the Trade and Regulatory team whose primary responsibility is to facilitate effective execution of compliant import/export activities within the global supply chain. This position will interface with US and Canada customs officers, customs brokers, and external customers, and will partner with internal business groups on all matters pertaining to customs and trade-related import and export activities. The Manager will provide strategic advice to the company on trade and regulatory activities, support the company’s growth from a global trade and regulatory compliance perspective, and partner with internal Legal Counsel in orchestrating global trade and regulatory compliance policies and procedures and mitigating the company’s risk.
RESPONSIBILITIES:
• Oversee and provide guidance to the Trade and Regulatory team on day-to-day trade and regulatory compliance matters which include, but are not limited to, the following: merchandise description and HTS classification, product qualification for preferential duty treatment under FTAs, custom broker management, and CTPAT.
• The Manager and team will consult internal Legal Counsel on matters which include, but are not limited to: country of origin determination and marking, Made in USA marketing determinations and corresponding claims, and providing product packaging and labeling guidance.
• Manage and oversee the maintenance of internal import/export processes, procedures and controls; upgrade and/or improve upon internal policies and processes to ensure on-going compliance in accordance with corporate policy guidelines.
• Manage duty savings programs such as Duty Drawback program, Duty Engineering, Defective Merchandise claims, Trade Preference Programs, etc.
• Work with internal Legal Counsel on the development, maintenance, and implementation of trade and regulatory compliance trainings to internal and external partners.
• Manage reports on import and export trade data in ACE and various other resources.
• Manage the Customs brokers in all facets required to best serve import and export operations and ensuring adherence to our KPIs, up to and including performance, quarterly reviews, and scorecard reports.
• Partner with the Tax Department and internal Legal Counsel on product valuation and valuation-related strategy issues; review company financials and internal reporting for consistency with Customs valuation policies.
• Stay abreast of US and Canadian trade laws and customs regulations as well as global standards; provide updates to management of new developments and potential risks/liabilities as well as any required modifications to current procedures.
• Manage the Supply Chain Compliance team’s resolution of Customs entry issues and concerns.
• Partner with internal Legal Counsel to perform periodic compliance audits to verify that internal controls are effective.
• Assist with strategic projects to improve efficiency, compliance and cost reduction initiatives.
• Partner with internal Legal Counsel on external audits and disclosures and other legal compliance matters.
• Advise the International and Supply Chain teams on imports requirements for company-owned stores on a global basis.
• Advise and assist stores opened by license partners (i.e., Licensed Locations) on import requirements on a global basis.
• Collaborate with other corporate regions (e.g. Mexico and Licensed Locations), as well as the Legal Department, the Production Team, the Tax Department, the Transportation Teams, and other internal departments on trade and regulatory compliance matters.
• Performs other duties as assigned.
QUALIFICATIONS:
• Minimum of 5 years of experience managing customs and international trade and regulatory compliance programs and 1-2 years of Supervisor or Management experience; experience in the apparel industry a plus.
• Current customs brokerage license preferred.
• Bachelor’s degree in business, supply chain or logistics and/or equivalent work experience.
• Excellent communication skills (both oral and written); demonstrated analytical, strategic thinking and problem-solving skills; strong organizational and time management skills; attention to detail.
• Solid knowledge and working understanding of international trade rules and regulations, including customs compliance, process control, internal and external audits: classification, valuation, Incoterms, origin, and PGA’s.
• Positive attitude toward customer service in meeting the needs of internal and external business partners including timely follow up and sense of urgency.
• Demonstrated ability to weigh risk areas and business objectives, to propose and implement realistic solutions, and to turn complex trade and regulatory compliance requirements into scalable processes.
• Ability to work well and manage others in a highly cross-functional and cross-regional team environment.
• Ability to drive complex, cross functional projects including setting scope, reaching consensus, executing on tasks, and presenting results.
• Ability to travel domestically and internationally.
Authority:
• Oversee day to day Trade and Regulatory Compliance team functions. Work is performed with close collaboration with internal Legal Counsel. Requires frequent contact with internal Legal Counsel on matters requiring judgment and diplomacy, risk/liability evaluation, and interactions with government personnel and other external third-parties. Errors may cause significant delays, affect company image or incur loss of revenue.
