The Role
The Sr. Vice President, Employment Law provides executive leadership, strategy, and legal representation relating to Lincoln Financial Group’s (LFG) employment law. He/she collaborates closely with legal team colleagues and key business leaders throughout the company, advising on legal risks, business strategies and other issues related to employment law. He/she is responsible for providing advice and solutions to HR and executive management on all aspects of labor, employment, immigration, and HR-related law, including discrimination and harassment prevention, EEO, workplace training, investigations, immigration, litigation oversight, diversity & inclusion, threat assessment, and wage & hour law compliance
Responsibilities
• Develops an overall strategic vision for the employment law functional area.
• Establishes the employment law organizational goals, objectives, metrics and operating procedures.
• Ensures employment law area is meeting all objectives pertaining to quality, compliance, regulations, productivity, customer service, budget, and project management.
• Ensures employment law operational plans are aligned with Lincoln Financial Group’s (LFG) overall business plans and specific strategic and tactical initiatives.
• Ensures the creation of enterprise strategies, systems and best practices to effectively support our HR team in carrying out employment related actions requiring legal guidance
• Assesses, identifies, communicates, and provides legal advice proactively to LFG’s executive leadership on current and anticipated employment law risks and their associated impacts; and current/emerging issues, trends, and regulatory/statutory changes facing the enterprise. Recommends mitigation strategies.
• Builds, enhances & maintains relationships with key HR, business leaders and senior executives to drive results, including: having a multifaceted understanding of business goals and marketplace pressures.
• Provides strategic vision for the department which is to provide insight and leadership related to employment law, so that business decisions mitigate risk while still allowing for compelling, competitive, and forward-thinking employment practices.
• Collaborates with HR leadership on employment related projects, including internal process reviews, new policy roll-outs and implementation, training programs, separation agreements and internal policies, and other employment related documents.
• Designs, implements, and maintains effective internal and disclosure controls and procedures intended to prevent unethical and illegal conduct.
• Provides highly specialized legal advice and thought leadership to executive leadership and key stakeholders on a wide range of legal employment matters. Ensures employment law obligations under relevant laws and the requirements of regulatory authorities are met.
• Oversees the investigation, analysis & documentation of employee relations issues.
• Develops creative approaches to managing legal risks and resolving disputes. Manage and drive strategy on employment-related pre-litigation and litigation matters.
• Represents LFG entities before government agencies relating to employment law.
• Oversees the assessment and enhancement of existing employment law programs/policies to ensure that they fully meet obligations of general & specific employment law risks for the enterprise.
• Leads the development and execution of strategic and consistent approaches to employment law reviews, issues and/or concerns to minimize the enterprise’s exposure.
• Oversees preparation of highly complex employment documentation such as contracts and legal agreements.
• Maintains knowledge of regulatory rules and requirements and emerging issues/trends around employment law and guides executive/senior management to incorporate new trends and developments in current and future strategies.
• Supports business strategies and initiatives by representing LFG at various Federal, State, and Local regulatory bodies and at industry associations and functions serving as a “thought leader”.
• Ensures that top talent is hired and retained for the Employment Law Team and provides stretch assignments, for team members and gives honest and open feedback to aid in the development of talent.
• Develops and fosters an environment that empowers team members to make decisions and take calculated risks in order to obtain goals and objectives in accordance with business needs and timelines.
Requirements
Education
• 4 Year/Bachelor's degree or equivalent work experience (4 years of experience in lieu of Bachelor's) (Minimum Required)
• Other: JD (Minimum Required)
Experience
• 15+ years of progressively more responsible experience in employment law, including at least 5+ years of experience in a senior legal leadership and strategy role influencing senior management and critical stakeholders;
• Senior in-house corporate experience preferred.
• Deep understanding of employment law, and ability to connect on unique and complex issues to deliver advice and counsel to all levels of the organization
• Demonstrated track record of developing and leading an employment law in-house practice, including creating a strategy, gaining buy in, and partnering with senior HR and other business colleagues
• Demonstrated experience managing employment litigation risks to mitigate organizational impact and reputational risks.
• Ability to create deep connections and partnerships with HR community and business leaders
• Deep understanding and application of insurance and financial industry specific accounting, finance processes.
• Demonstrated experience in developing strategic initiatives and plans which have benefited a company’s top and bottom lines.
• Demonstrated excellent relationship management skills with internal clients (i.e. executive management, peers, and colleagues) and external clients (Analyst, Investors, and LFG Board of Directors); proven ability to develop creative and collaborative approaches to driving client-focused solutions which also benefited the company’s top and bottom lines.
• Strong knowledge of insurance and financial services specific law is a plus.
• Ability to understand and analyze financial reports.
• Comprehensive understanding of the financial services industry and its business models a plus
• Computer skills: Microsoft Office Suite (Word, Excel, PowerPoint, & Outlook).
