Purpose and Scope:The attorney successful for this role will be given the opportunity to act as major contributor toward the achievement of the global anti-counterfeiting strategy’s mission statement and its strategic objectives.
Key Responsibilities:
• Proactively seeking input from relevant area general managers and other senior level internal clients to identify business priorities as they relate to appropriate focus of anti-counterfeiting activities in region of responsibility
• Working collaboratively with internal cross-functional teams that support anti-counterfeiting activities including Asset Protection and product security and authentication experts in the Quality, Manufacturing & Supply organization
• Contributing to quarterly and hoc reports on results of enforcement activities in region as requested/required
• Managing external legal counsel and designated service providers working on regional anti-counterfeiting activities and ensure compliance with relevant internal policies/protocols
• Developing and delivering anti-counterfeiting training materials to external national and regional law enforcement officers and customs authorities as well as awareness trainings for internal stakeholders
• Representing the company’s interests related to anti-counterfeiting activities in local, national and international industry associations
• Initiating civil and administrative cases and support criminal actions filed against manufacturers and large scale distributors of counterfeit products for designated countries in regions of responsibility
• Initiating website take-downs and/or civil actions against online counterfeiters and large scale online b2b distributors of counterfeit products and work with relevant online platforms to identify major online suppliers
• Managing the relationship with relevant customs authorities in all countries within region of responsibility and provide relevant information to customs authorities enabling them to conduct successful risk analysis. Responding to customs suspensions, detentions, and seizures in a timely manner and follow-up on destruction of seized products
Requirements:
• 4 years of experience in a full-time dedicated trade mark anti-counterfeiting enforcement role with a combination of law firm and in-house experience
• Law degree and currently licensed to practice
• Demonstrated first-hand experience working directly with customs and enforcement authorities
• Direct experience in successfully initiating/managing civil and administrative actions related to trade mark counterfeiting
• Ability to travel to high counterfeit risk markets and major transit countries to supervise anti-counterfeiting activities including intelligence gathering; training and ‘on the ground’ enforcement supervision/support
• Experience in successfully litigating against ‘significant’ players responsible for the distribution of counterfeit products in one or more countries within region of responsibility
• Flexibility and ability to multi-task and manage shifting priorities
• Must possess ability and background experience to work independently
• Must possess ability to manage team of enforcement directors globally
• Must be able to lead work on both tactical and strategic objectives in parallel
• Sensitivity to and practical knowledge of working with diverse cultures
